Terms of Service
These Terms of Service (“Terms”) govern access to and use of the OM+ platform, operated by Sandstone Summit LLC (“OM+,” “we,” “us”). By creating an account or using OM+, you agree to these Terms.
1. Description of Service
OM+ is a practice-management software platform built for orofacial myofunctional therapists, providing tools including patient records, scheduling, exercise programs, treatment planning, billing, and related features.
2. Accounts
You must provide accurate information when creating an account and are responsible for maintaining the confidentiality of your login credentials, including multi-factor authentication. You are responsible for all activity that occurs under your account.
3. Subscriptions and Billing
OM+ is offered on a subscription basis. Subscription fees are billed in advance on a recurring basis through our payment processor, Stripe. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We do not provide refunds for partial billing periods except as required by law.
4. Acceptable Use
You agree not to use OM+ to: violate any applicable law or regulation; upload or transmit content you do not have the right to share; attempt to gain unauthorized access to the platform or other accounts; or interfere with the platform’s normal operation.
5. Patient Data and HIPAA
If you use OM+ to store or process patient health information, you remain the HIPAA Covered Entity responsible for that information. OM+ acts as your Business Associate under a Business Associate Agreement, and handles patient information only as directed by you, consistent with our Privacy Policy.
6. Intellectual Property
OM+ and its underlying software, design, and content are owned by Sandstone Summit LLC. These Terms do not grant you any ownership rights in the platform. You retain ownership of the data you enter into OM+.
7. Disclaimer of Warranties
OM+ is provided “as is.” We do not warrant that the platform will be uninterrupted or error-free. OM+ is a practice-management tool and does not provide clinical judgment or medical advice; all clinical decisions remain the responsibility of the treating therapist.
8. Limitation of Liability
To the maximum extent permitted by law, Sandstone Summit LLC’s total liability for any claim arising from your use of OM+ shall not exceed the amount you paid us in the twelve months preceding the claim.
9. Termination
We may suspend or terminate access to OM+ for violation of these Terms. You may stop using OM+ and cancel your subscription at any time.
10. Governing Law
These Terms are governed by the laws of the State of Arizona, without regard to its conflict of laws principles.
11. Changes to These Terms
We may update these Terms from time to time. We will post any changes on this page.
